1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of PageMule (“PageMule”, “we”, “our”, or “us”).
By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.
If you are using the Service on behalf of a company or other legal entity, you represent and warrant that you have authority to bind that entity to these Terms.
2. Use of the Service
PageMule provides tools and services for creating, managing, publishing, and maintaining websites, web pages, content, and related functionality. You may use the Service only in compliance with these Terms and all applicable laws and regulations.
Acceptable Use
You agree not to:
- Use the Service for any unlawful, fraudulent, deceptive, or harmful purpose.
- Violate the rights of others, including intellectual property, privacy, publicity, or contractual rights.
- Upload, distribute, or transmit malware, malicious code, viruses, or harmful software.
- Attempt to gain unauthorized access to accounts, systems, networks, or data.
- Interfere with or disrupt the security, operation, or availability of the Service.
- Send spam, unsolicited communications, or abusive content through the Service.
- Circumvent usage limits, billing mechanisms, security controls, or access restrictions.
- Resell, sublicense, rent, lease, or otherwise provide access to the Service to unauthorized third parties.
- Use automated means to access the Service in a manner that places excessive or unreasonable load on our infrastructure.
- Reverse engineer, copy, scrape, modify, or otherwise exploit the Service except as expressly permitted by law.
Suspension and Termination
We may suspend, restrict, or terminate access to the Service if you violate these Terms, if your use creates legal, operational, security, or reputational risks, if payment obligations remain unpaid, or if required by law or regulatory authority.
We may also suspend access for maintenance, upgrades, abuse prevention, security incidents, or other operational purposes. Upon termination, your right to access and use the Service immediately ends.
3. Account and Access
You are responsible for:
- Maintaining the confidentiality and security of your account credentials.
- All activities occurring under your account.
- Keeping your account information accurate and up to date.
- Obtaining and maintaining any devices, internet connections, domains, DNS settings, software, or third-party services required to use the Service.
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.
4. Customer Responsibilities
You are solely responsible for your use of the Service and for all content, settings, configurations, and activities associated with your account. Specifically, you are responsible for:
- Maintaining ownership, authorization, or control of any domains, subdomains, or online properties connected to the Service.
- Configuring and maintaining DNS records and related settings required for the Service to function properly.
- Reviewing and verifying any content generated or modified through AI-powered features before publishing or distributing it.
- Maintaining appropriate backups of your content and data.
- Protecting the confidentiality and security of your account credentials and connected services.
You represent and warrant that:
- You have all necessary rights, permissions, licenses, and authority to use, publish, and distribute any content submitted to the Service.
- Your use of the Service does not violate any applicable law, regulation, contract, or third-party right.
- You will not use the Service to distribute unlawful, fraudulent, defamatory, infringing, harmful, or misleading content.
PageMule is not responsible for loss of traffic, rankings, revenue, or business opportunities; errors resulting from domain, DNS, hosting, or third-party configurations; content published or generated through your account; or data loss caused by user actions, third-party services, or circumstances beyond our reasonable control.
You remain solely responsible for all decisions made based on information, content, or outputs generated through the Service.
5. Subscription and Billing
Certain features of the Service require a paid subscription. Subscriptions may be offered on monthly or annual billing cycles. Subscription fees are billed in advance and are non-refundable except as expressly stated in these Terms.
We may modify pricing, plans, features, limits, or functionality at any time. Changes to subscription pricing will apply at the start of your next billing cycle.
Automatic Renewal
Unless cancelled, subscriptions automatically renew at the end of each billing period. You authorize us to charge your selected payment method for all applicable fees, taxes, and charges.
AI Credits
Certain features may consume AI credits or usage-based allowances. Unless otherwise stated, AI credits have no cash value, are non-transferable, and may expire at the end of the applicable billing period. We may modify credit allocations, consumption rates, limits, or policies at any time.
Cancellation
You may cancel your subscription at any time. Cancellation prevents future renewals but does not provide refunds for the current billing period unless required by law. Access to paid features may continue until the end of the active subscription period.
Refund Policy
Subscription fees are generally non-refundable. Refunds may be considered only when a verified technical issue substantially prevents use of the Service and we are unable to resolve the issue within a reasonable period. Refund requests must be submitted within fourteen (14) days of the applicable charge. The refund amount shall not be more than the last payment.
6. Content Ownership and License
Your Content
You retain ownership of all content, data, files, text, images, media, and materials that you upload, submit, publish, generate, or otherwise provide through the Service (“User Content”). We do not claim ownership of your User Content.
You are solely responsible for obtaining any permissions, licenses, consents, or legal rights necessary for the content you upload, publish, generate, or distribute through the Service.
License to Operate the Service
You grant PageMule a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, modify, transmit, and display your User Content solely as necessary to provide and maintain the Service, ensure security and reliability, and comply with legal obligations. This license ends when your content is deleted, except where retention is required for legal, security, backup, or compliance purposes.
Feedback
If you provide suggestions, feedback, ideas, or feature requests, you grant us the right to use them without restriction or compensation.
7. Intellectual Property
The Service, including software, technology, source code, designs, interfaces, trademarks, logos, and documentation, is owned by PageMule or its licensors and is protected by applicable intellectual property laws. Except for the rights expressly granted under these Terms, no rights are transferred to you.
8. AI Features and Beta Services
AI Features
The Service may include AI-powered functionality. You acknowledge and agree that:
- AI-generated output may be inaccurate, incomplete, outdated, or unsuitable for your intended use.
- You are responsible for reviewing and verifying any AI-generated output before relying on, publishing, or distributing it.
- AI-generated output may not be unique and similar output may be generated for other users.
- We do not guarantee the accuracy, legality, reliability, originality, or fitness of AI-generated output.
You remain solely responsible for your use of AI-generated output.
Beta Features
From time to time, PageMule may offer features designated as alpha, beta, preview, early access, or experimental (“Beta Features”). Beta Features are provided for testing and evaluation purposes. They may be incomplete, change substantially before general release, or be modified, suspended, or discontinued at any time.
You acknowledge that Beta Features may be less reliable than generally available features and may not be suitable for production use. To the maximum extent permitted by law, Beta Features are provided “as is” without warranties of any kind, and PageMule shall have no liability arising from your use of Beta Features.
9. Fair Use Policy
PageMule plans may include usage allowances, AI credits, storage, bandwidth, API access, and other resources. Your use must remain reasonable and consistent with the intended purpose of your subscription plan.
You may not create multiple accounts or workspaces to circumvent plan restrictions, or use the Service in a manner that places excessive demands on our infrastructure. If your usage materially impacts Service performance, security, stability, or costs, we may require an upgrade, apply temporary restrictions, or suspend access in cases of repeated abuse.
We reserve the right to define, modify, and enforce reasonable usage limits as necessary to maintain the reliability and sustainability of the Service.
10. Usage Data and Third-Party Services
Usage Data
We may collect and use aggregated, anonymized, and operational data generated through use of the Service for purposes including operating and maintaining the Service, improving features, monitoring performance, and security and fraud prevention. Such data will not identify you or disclose your User Content except as described in our Privacy Policy or as required by law.
Third-Party Services
The Service may integrate with or rely upon third-party providers including hosting providers, payment processors, AI providers, analytics providers, domain providers, CDN providers, and other vendors. Your use of third-party services may be subject to their respective terms and policies. PageMule is not responsible for third-party products, services, content, availability, performance, or actions.
11. Service Availability
We strive to provide a reliable Service but do not guarantee uninterrupted availability. The Service may experience interruptions resulting from scheduled or emergency maintenance, infrastructure failures, third-party service outages, network disruptions, security incidents, or events beyond our reasonable control (including natural disasters, acts of government, labor disputes, power outages, or cyberattacks).
We may modify, suspend, discontinue, replace, or remove features at any time. PageMule shall not be liable for any delay, interruption, or failure resulting from such events.
12. Disclaimers
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAGEMULE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, AND SECURITY.
WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, UNINTERRUPTED, OR THAT ANY RESULTS OBTAINED FROM THE SERVICE WILL MEET YOUR EXPECTATIONS.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAGEMULE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITIES, OR BUSINESS INTERRUPTION.
OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO PAGEMULE DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
14. Indemnification
You agree to defend, indemnify, and hold harmless PageMule, its affiliates, officers, directors, employees, contractors, agents, and partners from and against any claims, liabilities, damages, losses, costs, and expenses arising from your use of the Service, your User Content, your violation of these Terms, or your violation of applicable laws or third-party rights.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in India.
16. Modifications to Terms
We may update these Terms from time to time. If we make material changes, we may notify users through the Service, by email, or by other reasonable means. Your continued use of the Service after revised Terms become effective constitutes acceptance of the updated Terms.
